What effect will the new Labor Department regulation on overtime exemption have on small employers? The Fair Labor Standards Act can be a minefield for employers with its liquidated damages and attorney’s fees provisions. DOL’s recent announcement of its final rule raising the annual minimum salary requirements for “white collar” exemptions from $23,660 per year ($455 per week) to $35,568 per year ($684 per week) could result in 1.3 million employees who are currently classified as exempt becoming non-exempt. For small employers, this change will be felt more acutely. One way to mitigate overtime costs would be to increase the salaries of employees already making just under the new $35,568 threshold so that their new salaries exceed that amount. Doing so may be cheaper than paying for overtime. For employees making considerably less, employers will need to consider reducing those employees and hiring more people to ensure that no one works overtime.
